These Terms of Service (“Terms”) govern your use of matthewszt.com (the “Site”) and purchases from MATTHEWS ZERULONIX TRADING LLC, a Kentucky limited liability company (“matthewszt,” “we,” “us”). By using the Site or placing an order, you agree to these Terms.
1. Eligibility
You must be at least 18 years old, or the age of majority where you live, to place an order.
2. Products and descriptions
We work to describe products, colors, dimensions and specifications accurately. Colors may vary by screen and natural materials such as wood, bamboo and water hyacinth vary from piece to piece. Images may include styling items that are not included.
3. Pricing and availability
Prices are in U.S. dollars and may change without notice. We may correct pricing errors and cancel orders affected by an obvious error, in which case any payment will be refunded in full. Products are subject to availability.
4. Orders
Your order is an offer to purchase. We accept it when we ship the products and send a shipping confirmation. We may limit or cancel quantities, including orders that appear fraudulent or are placed for resale without a wholesale agreement.
5. Payment and taxes
You authorize us and our payment processors to charge your selected payment method for the order total, including shipping and applicable sales tax.
6. Shipping, risk of loss and returns
Shipping is governed by our Shipping Policy and returns by our Returns & Refunds Policy. Risk of loss passes to you on delivery to the carrier; we will still help resolve lost or damaged shipments as described in those policies.
7. Assembly and safe use
Follow all assembly, anti-tip, weight-limit and care instructions included with your product. Storage furniture that includes an anti-tip kit must be anchored to the wall. Outdoor furniture should be secured or stored during high winds and severe weather.
8. Warranty disclaimer
Except for any written limited warranty included with a product, and to the extent permitted by law, products and the Site are provided “as is” without warranties of any kind, express or implied, including merchantability and fitness for a particular purpose. Some states do not allow these exclusions, so they may not apply to you.
9. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential damages. Our total liability for any claim relating to a product will not exceed the amount you paid for that product.
10. Intellectual property
Site content, including text, graphics, logos and images, belongs to MATTHEWS ZERULONIX TRADING LLC or its licensors and may not be copied without permission. “matthewszt” and the mz logo are brand names of MATTHEWS ZERULONIX TRADING LLC.
11. Acceptable use
You agree not to misuse the Site, interfere with its operation, attempt unauthorized access or post unlawful or misleading content.
12. Reviews
Product reviews may only be submitted by verified purchasers and must reflect your honest experience. We do not offer compensation for positive reviews and may moderate content for legality and relevance, but we do not remove reviews because they are negative.
13. Governing law and venue
These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict-of-law rules. Any dispute will be brought exclusively in the state or federal courts located in Fayette County, Kentucky, and you consent to their jurisdiction. Nothing in these Terms limits rights you have under the consumer protection laws of your state.
14. Changes
We may update these Terms by posting a revised version. Changes do not apply to orders placed before the update.
